You probably already know that our Silvester v. Becerra lawsuit is at the Supreme Court.

You’ve probably already seen how we litigated this case to a major victory at the Federal District Court following full discovery and a 3-day trial….and how the 9th Circuit Court of Appeals jumped through hoops to give the State a win on appeal.

You probably remember that the 9th Circuit’s decision was so bad that they ignored the text (“shall not be infringed”), history, and tradition of the Second Amendment -- not to mention Heller and McDonald -- and argued that the Waiting Period Laws’ burden on gun owners was “very small” in reversing the trial court’s Findings of Fact and Conclusions of law.

And you’ve probably already heard that the outcome in our Silvester case could determine not only the constitutionality of California’s 10-day waiting period for law-abiding gun owners, but how the lower courts are supposed to analyze Second Amendment cases across the United States, period.

The State of California and anti-gun Attorney General Xavier Becerra, waived their response back in September. They wanted to hide behind the 9th Circuit’s awful opinion.

But in a significant development, the Supreme Court has ordered Becerra and the State of California to respond to the arguments made in our petition -- and their response brief is due on October 30th.

Once they file their response, our lead Supreme Court counsel -- who clerked for Justice Clarence Thomas, as well as Judge Douglas H. Ginsburg of the D.C. Circuit, and has been involved in over 100 separate Supreme Court matters -- will have one last shot to counter the State’s nonsense and convince the Court to take this case….and fix the 9th Circuit’s mess.
